Terms & Conditions - The Fine Print to our design processes


How we work with you

The first step is you simply telling us what you want, referred to in the industry as your brief. Palomo Graphics requires you to fill out our electronic web forms pertaining to the brief you wish to be quoted on. We will then prepare an estimate that will fulfil the requests in your brief. This will be fully discussed and adjusted if necessary, with you before any creative or production work is commenced. Once you are happy with our quote we will ask you to pay a deposit to begin the design process. Alterations ordered by the Client that require significant research or design time will of course attract an additional fee. Artwork quotes are valid for 30 days from the date of the quote. Where applicable, an estimated timeline will also be supplied at the time of quotation.

Authors Corrections

A reasonable level of author's corrections is acceptable within the estimate at no extra cost. This will include minor changes to original text and the re-positioning of text. It will also include changes to picture size and positioning and any changes to details such as addresses, etc. Original estimates include one set of corrections, unless otherwise stated. Work in excess of this will attract a fee for additional time required. Palomo Graphics shall make every effort to ensure the final product is free of any grammatical and spelling errors, before giving the final product to the Client. It is agreed that it is the Client's responsibility to ensure that there are no spelling or grammatical errors contained in the final product. It is agreed that Palomo Graphics is not responsible or held liable for any errors contained in the final product after the final product has been committed to print or posted in view of the public.


Invoicing & Payment

All projects require a 50% deposit of the total cost of the project. A "progressive invoice" may be issued for any projects placed on hold for more than 30 days, subject to standard trading terms. The final invoice will be issued at the completion of the project. When Palomo Graphics procure goods or services from third party suppliers on your behalf, a small fee is applied to cover handling. Under no circumstances will work be performed free of charge - please don't ask as refusal often offends.


Cancellation

In the event of cancellation of the project, ownership of all copyrights and the original artwork and disks shall be returned and retained by Palomo Graphics, and the deposit nonrefundable. Should the project re-commence, Palomo Graphics have the authority to re-estimate the original quote.


Overdue Accounts

Palomo Graphics may charge interest at four percent (4%) on amounts not paid within the time specified in Palomo Graphics invoice. The Client must pay to Palomo Graphics any costs, expenses or losses incurred by Palomo Graphics as a result of the Client's failure to pay to Palomo Graphics all sums outstanding as owed by the Client to Palomo Graphics including without limiting the generality of the forgoing any debt collection and legal costs incurred in enforcing payment on a solicitor and own client basis.


Management of Files

Palomo Graphics will archive digital files of completed project work as a free service for our Clients for a period of two years. You may request copies of your artwork, however if the search, retrieval and distribution of physical and/or electronic files from archives is time consuming you will therefore attract a nominal fee. Please note that in some situations, archived files may not be accessible, due to incompatibility with current computer software and/or storage media deterioration or corruption. Palomo Graphics will take every care to preserve all digital files, however we cannot be held responsible for re-producing work free of charge in the event that files cannot be recovered. We do not generally use Microsoft programs for design - we only use professional design software, however requests for the supply of copies of your files in these formats may attract a nominal fee but cannot be guaranteed.


Confidentiality

All correspondence and documents provided will be treated as confidential between Palomo Graphics and the Client, unless consent has been granted by both parties involved.


Copyright

Palomo Graphics retains ownership of all original artwork or parts contained therein, whether preliminary, concept or final. Upon full payment, the Client has the rights to use the final artwork for the purposes for which it was commissioned. This does not entitle the Client the full copyrights, rather a license to use the final artwork for the purposes for which it was commissioned. For example, a logo designed by Palomo Graphics is licensed to a Client allowing the Client to reproduce and communicate the logo design to the public as well as trademark the logo, however, modifications to the logo are not prohibited without Palomo Graphics permission.

Copyrights to a paid final artwork or final design may be assigned and transferred to the Client based on a nominal fee if you have requested. A written agreement will be produced in exchange for this nominal fee. Please note Palomo Graphics retains the rights to use the work for the purposes of promoting our services and is not obliged to assign these rights when a transfer of copyrights has been requested - please do not ask us as refusal often offends.

Should you require the original working files to all artworks with the exception of logo design, they can be supplied on CD and the Client will be invoiced a nominal fee. This does not extend to the use of concepts and/or peripherals developed during the course of the project which were not selected as part of the final design.

Palomo Graphics retains the right to use the completed project and any preliminary designs for the purpose of design competitions, future publications on design, educational purposes, marketing materials, and portfolio. Where applicable the Client will be given any necessary credit for usage of the project elements.

The client agrees to provide Palomo Graphics with text, images, graphics, photographs and other material which does not infringe upon the rights of any third party or copyright legislation.

As such Palomo Graphics takes every possible care with professional advice offered and any suggested creative concepts and/or their implementation, however we cannot be held responsible for variations between expectation and outcome.
